Nebraska High Court Reasserts Parental Rights

The Nebraska Supreme Court issued a very good decision in the case of Nebraska ex rel. Tina K. vs. Adam B. and Jo K. It’s not as perfect as I’d like, but it clearly sets out the conditions under which a court may deprive a parent of the care, love and companionship of his/her child. The court adopted the reasoning of a New Jersey Supreme Court case that held that the preference accorded biological parents can only be overridden in rare circumstances, defined as “serious physical or psychological harm or a substantial likelihood of such harm.” read more
